However, vaping is regulated under the state’s broader smoking and tobacco laws, which include restrictions on where vaping can occur, particularly in public and indoor spaces. The Smokefree Alaska Law prohibits vaping in workplaces, public buildings, bars, restaurants, and within specified distances of entrances and playgrounds, but these restrictions are generally separate from driving regulations.

While vaping itself is not banned when driving, Alaska law prohibits driving while impaired by any substance, including nicotine and other chemicals. If vaping leads to distracted driving or impairment, it could potentially be cited under unsafe driving or distracted driving laws. Police may consider vaping as a distraction if it interferes with the safe operation of a vehicle, similar to the way they treat mobile phone use or eating while driving.
