In Texas, it is illegal to leave your pet, specifically a dog, chained outside under most circumstances. The Safe Outdoor Dogs Act, which took effect on January 18, 2022, prohibits the use of chains or heavy weights as restraints for dogs left outdoors. Instead, owners must use humane tethers, such as trolley systems, that are at least ten feet long or five times the length of the dog, whichever is greater. The restraint must be attached to a properly fitted collar or harness, and not cause pain or injury to the animal.

Additionally, the law requires that any dog left outside and unattended must have access to adequate shelter from inclement weather, shade from direct sunlight, potable water, and an area free from standing water and excessive animal waste. The shelter must be a sturdy structure large enough for the dog to stand, sit, turn around, and lie down normally. The law also eliminates the previous 24-hour warning period, allowing law enforcement to intervene immediately if a dog is found in illegal or inhumane conditions.

Violating the law is a Class C misdemeanor, punishable by a fine of up to $500. Repeat offenders can be charged with a Class B misdemeanor, which can result in up to 180 days in jail and/or a fine of up to $2,000. There are exceptions for temporary restraint in certain situations, such as public camping or recreational areas, and the law does not prohibit walking a dog with a handheld leash.

Chaining a dog outside in Texas is illegal unless the animal is restrained humanely and provided with proper care and shelter as outlined by the Safe Outdoor Dogs Act. Failure to comply can result in criminal penalties.
